Welcome to The Sweet Plug! These Terms and Conditions ("Terms") govern your use of our website at https://www.the-sweetplug.com and your purchase of any products from The Sweet Plug, a home-based dessert business owned and operated by Chris Neal. By visiting our website, placing an order, or purchasing any of our products, you agree to be bound by these Terms. Please read them carefully before completing your purchase.


Section 1: Acceptance of Terms

By accessing or using our website, placing an order, or making a purchase from The Sweet Plug through any channel (online, phone, social media, or in person), you confirm that you have read, understood, and agreed to these Terms. If you do not agree with any part of these Terms, please do not use our website or place an order.

These Terms apply to all customers, visitors, and users of The Sweet Plug's website and services. We reserve the right to update or modify these Terms at any time, and your continued use of our website or services after any changes constitutes your acceptance of the revised Terms.

Section 2: Products & Ordering

The Sweet Plug specializes in handcrafted, made-to-order desserts including cookies, cake pops, party packs, variety packs, and other seasonal or custom items. Please review the following important details about our ordering process:

●Made to Order: All of our products are made fresh to order. We do not maintain a standing inventory of ready-made items. This means your order will be prepared specifically for you after it is placed and confirmed.

●Limited Availability: Product availability may vary by season, ingredient availability, and our production capacity. We reserve the right to limit quantities, discontinue items, or decline orders at our discretion.

●Custom Orders: We welcome custom order requests for events, parties, and special occasions. Custom orders require advance notice and are subject to availability. Details such as flavors, designs, colors, and quantities for custom orders must be agreed upon in writing (via email or direct message) prior to payment. Once a custom order is confirmed and paid, it is considered final.

●Order Confirmation: Your order is not considered confirmed until you have received a confirmation from The Sweet Plug via email or direct message. We reserve the right to cancel or modify orders due to ingredient unavailability or capacity constraints, in which case you will receive a prompt notification and a full refund if payment has already been processed.

All orders are placed through our website at https://www.the-sweetplug.com or through our social media channels (@the_sweet_plug1 on Instagram, TikTok @thesweetplug19, and Facebook).

Section 3: Pricing & Payment

All prices listed on our website are in U.S. dollars and are subject to change without notice. The price you are charged will be the price displayed at the time your order is placed and confirmed.

Payments are processed securely through Wix Payments. We accept all major credit and debit cards as supported by Wix Payments. By submitting payment, you represent that you are authorized to use the payment method provided and that the billing information you supply is accurate and complete.

All sales are final. Due to the perishable and custom-made nature of our products, we do not offer refunds or exchanges once an order has been confirmed and payment has been accepted, except in cases where The Sweet Plug is at fault (e.g., incorrect order, significant quality issue, or failure to fulfill the order). Please see Section 4 for details on cancellations and modifications.

The Sweet Plug is not responsible for any additional fees, including but not limited to bank fees, currency conversion charges, or transaction fees imposed by your financial institution.

Section 4: Order Cancellations & Modifications

We understand that plans can change. Please review our cancellation and modification policy carefully before placing your order:

●Cancellation Window: If you need to cancel or modify your order, you must contact us within 24 hours of placing the order. Cancellations or modification requests made after the 24-hour window cannot be accommodated, as production on your order may have already begun.

●How to Contact Us: To request a cancellation or modification, please reach out to us as soon as possible at info@the-sweetplug.com or by phone at 386-576-7219 during our operating hours (Monday through Sunday, 8:00 AM – 5:00 PM).

●Approved Cancellations: If your cancellation request is approved within the 24-hour window and payment has already been processed, we will issue a full refund to the original payment method. Please allow several business days for the refund to be reflected in your account.

●Custom Orders: Custom orders (including event orders) may have a separate, extended cancellation policy that will be communicated to you at the time of booking. Any deposit paid on a custom order may be non-refundable depending on the terms agreed upon at the time of the order.

●The Sweet Plug Cancellations: In the rare event that we need to cancel your order due to unforeseen circumstances (illness, ingredient shortages, equipment issues, etc.), we will notify you as promptly as possible and issue a full refund.

Section 5: Pickup & Delivery Terms

The Sweet Plug currently offers two fulfillment options: local pickup and local delivery. Both options are subject to the terms outlined below.

Local Pickup: Pickup is available at our location at 1919 Hollybrooke Rd, Edgewater, FL 32141 during operating hours (Monday through Sunday, 8:00 AM – 5:00 PM). Your order pickup time will be confirmed at the time of purchase. Please be prepared to pick up your order during the confirmed time window. We are not responsible for orders left unclaimed beyond the agreed pickup time. Perishable items that are not picked up at the scheduled time may not be held beyond that window.

Local Delivery: Local delivery is available within our designated delivery area. Delivery availability, timeframes, and any applicable delivery fees will be communicated at the time of ordering. It is the customer's responsibility to ensure that someone is present at the delivery address to receive the order at the scheduled time. The Sweet Plug is not responsible for products that are left unattended after a delivery attempt has been made in good faith.

Because our products are perishable food items, they should be consumed or stored properly as directed upon receipt. The Sweet Plug is not responsible for product quality issues that result from improper storage, handling, or failure to receive a delivery or pickup in a timely manner.

Risk of loss and title for products passes to you upon our completion of the delivery or your receipt of a pickup. The Sweet Plug is not liable for any damage to products that occurs after the order has been transferred to you or left at your delivery address.

Section 6: Allergen Disclaimer

THE SWEET PLUG IS A HOME-BASED KITCHEN OPERATION. OUR PRODUCTS ARE PREPARED IN A HOME KITCHEN THAT IS NOT SUBJECT TO STATE INSPECTION.

Our kitchen regularly handles and uses the following common allergens:

●Milk (dairy)

●Eggs

●Wheat (gluten)

●Soy

●Peanuts

●Tree Nuts

While we take reasonable precautions to maintain cleanliness and minimize contamination, our kitchen is NOT allergen-free. We do not guarantee that any product is free from allergens, as cross-contact with allergens is possible during the preparation, baking, and packaging process.

If you or a recipient of our products has a known food allergy, sensitivity, or dietary restriction, it is your sole responsibility to notify us before placing your order so we can advise whether we are able to accommodate your needs. We strongly encourage customers with serious food allergies to consult with their healthcare provider before consuming our products.

THE SWEET PLUG IS NOT RESPONSIBLE FOR ANY ALLERGIC REACTIONS, ADVERSE REACTIONS, ILLNESS, INJURY, OR ANY OTHER HARM ARISING FROM CONSUMPTION OF OUR PRODUCTS BY ANY PERSON WITH KNOWN OR UNKNOWN FOOD ALLERGIES OR SENSITIVITIES. BY PLACING AN ORDER, YOU ACCEPT FULL RESPONSIBILITY FOR REVIEWING AND UNDERSTANDING THE INGREDIENTS AND ALLERGEN RISKS ASSOCIATED WITH OUR PRODUCTS.

Section 7: Florida Cottage Food Disclosure

The Sweet Plug operates as a cottage food business under Florida Statute § 500.80 (the Florida Cottage Food Law).

In accordance with this law, please be aware of the following:

●Our products are produced in a home kitchen that is not inspected by the Florida Department of Agriculture and Consumer Services or any other federal, state, or local food safety agency.

●Our products are not intended for resale through third-party retail establishments. They are sold directly to end consumers only.

●Under Florida Statute § 500.80, we are permitted to sell cottage food products directly to customers, including via our website, for personal or household consumption.

By purchasing from The Sweet Plug, you acknowledge and accept that our products are made in an uninspected home kitchen under the protections and limitations of the Florida Cottage Food Law.

Section 8: Intellectual Property

All content associated with The Sweet Plug, including but not limited to our name, logo, branding, photographs, product images, graphics, website design, written content, and social media content, is the exclusive intellectual property of The Sweet Plug and its owner, Chris Neal.

You may not copy, reproduce, distribute, publish, display, modify, create derivative works from, or otherwise exploit any content from The Sweet Plug's website or social media channels without our prior written consent. This includes but is not limited to our product images, branding materials, and written descriptions.

Any unauthorized use of our intellectual property may subject you to civil and/or criminal liability under applicable intellectual property laws.

Section 9: Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SWEET PLUG AND ITS OWNER, EMPLOYEES, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR PURCHASE OR USE OF OUR PRODUCTS OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall our total liability to you for any claim arising out of or related to these Terms, your use of our website, or any products purchased from us exceed the total amount you paid to The Sweet Plug for the specific order giving rise to the claim.

Nothing in these Terms shall limit or exclude our liability for personal injury or death caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.

We make no warranties, express or implied, regarding our products other than as expressly stated in these Terms. All products are sold "as-is" subject to our quality standards as described at the time of sale.

Section 10: Governing Law

These Terms and any disputes arising out of or related to them or your use of our website or purchase of our products shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Volusia County, Florida, and you hereby consent to the personal jurisdiction and venue of such courts.

Section 11: Changes to These Terms

The Sweet Plug reserves the right to update, modify, or replace these Terms at any time at our sole discretion. When we make material changes, we will update the "Effective Date" at the top of this document and, where practicable, post a notice on our website.

It is your responsibility to review these Terms periodically for any changes. Your continued use of our website or placement of an order after any changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, please discontinue use of our website and services.
